Mediation (ADR)

Mediation is a form of Alternative Dispute Resolution (ADR) where a neutral third party, called a mediator, helps parties in a dispute reach a mutually acceptable agreement.

The mediator does not have the authority to impose a decision on the parties, but instead facilitates communication and negotiation between them, helping them to clarify their issues, identify interests, and explore potential solutions. The mediator does not take sides or offer legal advice, but instead remains impartial throughout the process.

Mediation is often used in family law, workplace disputes, and commercial disputes. It is a confidential process, which means that information shared during mediation cannot be used in any subsequent legal proceedings unless agreed upon by the parties.

The benefits of mediation include the flexibility of the process, the ability of the parties to control the outcome, and the potential for a quicker and less expensive resolution compared to going to court. Mediation can also help to preserve relationships and promote better communication between parties, which can be particularly important in ongoing or future relationships.

Our licensed lawyers can play a crucial role in mediation through acting as mediators to a dispute or by representing clients, providing legal advice, and helping to draft agreements.
